2. Acceptance of these Terms

By using the website or placing an order, you agree to these Terms. The following policies form part of these Terms: our Shipping Policy, our Refund & Cancellation Policy and our Privacy Policy. If you do not agree, please do not use the website or place an order.

3. Who may use the website and buy

  • You may place an order if you are competent to enter into a contract under Indian law.
  • If you are under 18, you may use the website and place orders only with the involvement of a parent or guardian, who accepts these Terms on your behalf.
  • We deliver only to addresses in India.

4. Your information

  • You must provide accurate, complete and current information, including your name, mobile number and delivery address, and keep it up to date for any open order.
  • You may buy as a guest. Where account sign-in is offered, you are responsible for activity carried out through your account and for signing out on shared devices.
  • Please tell us promptly if you believe your account or order information has been misused.

5. Products

  • We take reasonable care to describe our products accurately. Product descriptions, ingredients and food information on the website are provided for your information; the declarations printed on the pack you receive are authoritative.
  • Product images are for illustration. Packaging designs, colours and artwork may change from time to time, and the pack you receive may not look exactly like the image, without any change to the product itself.
  • Please read the ingredient and allergen information on the pack before use, particularly if you have allergies or dietary restrictions.
  • Our products are food products. Nothing on the website is intended as medical advice or as a claim that any product treats, cures or prevents any disease.

6. Availability

  • Products can be ordered only while they are shown as available. A product that is out of stock remains visible but cannot be added to the cart.
  • Availability is checked again when you place your order. Stock can change while you shop, and a product may become unavailable before your order is confirmed.
  • We may limit the quantity of any product per order.

7. Prices, MRP, discounts and taxes

  • Prices are in Indian Rupees.
  • The maximum retail price (MRP) shown is inclusive of all taxes. Where a discount applies, the selling price is shown alongside the MRP.
  • The product selling price shown is inclusive of GST. The applicable GST is shown at checkout and on your order.
  • Prices, discounts and offers may change at any time, but a change does not affect an order that has already been confirmed.
  • Tax is charged in accordance with applicable GST law, including the applicable place of supply.

8. Pricing and technical errors

Despite our care, a price or product description may occasionally be shown incorrectly because of an obvious error, or an order may be accepted because of a technical fault. Where an error is obvious, or ought reasonably to have been recognised as an error, we may decline or cancel the affected order, even after it has been confirmed, and refund the full amount paid for it. We will tell you if this happens.

9. Shipping charges

Shipping charges are calculated for your delivery address, parcel and chosen delivery option, and are shown at checkout before you pay, inclusive of applicable GST. Details are in our Shipping Policy.

10. Placing an order and acceptance

  • When you proceed to payment, you make an offer to buy the products in your order. An order number shown at that stage identifies your order; it does not by itself mean the order has been accepted.
  • Your order is accepted, and a contract is formed, when we confirm the order after independently verifying your payment and completing our order checks.
  • We may decline or cancel an order for legitimate reasons, including those set out in our Refund & Cancellation Policy (such as unavailability, an obvious error, an unserviceable address, payment verification concerns or suspected fraud). If we cancel an order you have paid for, we will refund the amount due under that policy.

11. Payment

  • All orders must be paid in advance. Cash on delivery is not available at present.
  • Payments are processed by our payment service provider, Razorpay. The payment methods offered depend on what Razorpay makes available for our account. Your use of Razorpay’s payment pages is also subject to Razorpay’s terms.
  • We confirm an order only after we have verified the payment with Razorpay. A success message shown in your browser or payment app is not, by itself, confirmation of your order.
  • If your payment fails, no order is confirmed and you may try again. If your account is debited but you do not receive a confirmation, please do not pay again; contact us instead (see our Refund & Cancellation Policy).
  • You must use only payment methods that you are authorised to use.

12. Delivery

We deliver as described in our Shipping Policy. Delivery estimates are indicative and not guaranteed. Ownership of, and risk in, the products pass to you when they are delivered to the delivery address you gave us.

13. Cancellations, returns and refunds

Cancellations, returns, replacements and refunds are governed by our Refund & Cancellation Policy. In summary, because our products are food items, cancellation is ordinarily not available once an order has been confirmed, and change-of-mind returns are not ordinarily accepted, but we will review and remedy genuine problems such as wrong, damaged or missing items — always subject to your rights under applicable law.

14. Handling and storing food products

Once your order has been delivered, please store and use the products as directed on the pack and consume them before the best-before date. We are not responsible for deterioration caused by storage or handling contrary to the pack instructions, to the extent permitted by law.

15. Using the website

You agree not to:

  • use the website for any unlawful, fraudulent or harmful purpose;
  • place false, speculative or fraudulent orders, or use another person’s details or payment method without authority;
  • attempt to gain unauthorised access to the website, our systems, or another person’s account or information;
  • interfere with, disrupt or overload the website, or introduce malicious code;
  • use automated tools to access, copy, scrape or monitor the website or its content without our written permission; or
  • copy, modify, reverse-engineer or exploit any part of the website except as permitted by law.

16. Fraud and misuse

If we reasonably suspect fraud, misuse or a breach of these Terms, we may, to the extent permitted by law, decline or cancel orders, restrict access to the website, and report the matter to the appropriate authorities. Where we cancel a paid order for this reason, any refund due will be handled in accordance with applicable law.

17. Intellectual property

The Aha Rasam name and logo, product names, packaging designs, photographs, text, graphics and the design of the website are owned by or licensed to us and are protected by intellectual property laws. You may view the website for personal, non-commercial use. You may not copy, reproduce, distribute, modify or use any of this material, or use our names or marks, without our prior written permission, except as permitted by law.

18. Third-party services

We rely on third-party service providers, including Razorpay for payments, Shiprocket and courier companies for delivery, and hosting and security providers to run the website. Their services may be subject to their own terms. We remain responsible to you for our obligations under these Terms, but, to the extent permitted by law, we are not responsible for failures of third-party services that are outside our reasonable control. Links to third-party websites are provided for convenience only.

19. Website availability

We aim to keep the website available and working correctly, but we do not guarantee that it will always be available, uninterrupted or error-free. We may suspend or change the website, for example for maintenance, security or improvements.

20. Disclaimers

To the extent permitted by law, the website and its content are provided for general information about our products and services. We do not make promises about the website beyond those set out in these Terms and in applicable law.

21. Limitation of liability

  • Nothing in these Terms excludes or limits any liability that cannot be excluded or limited under applicable law, including liability for fraud, for death or personal injury caused by negligence, or under consumer protection or food safety law.
  • Subject to that, and to the extent permitted by law, we are not liable for any indirect or consequential loss, or for loss of profit, business or opportunity, arising from your use of the website or any order.
  • Subject to the same exceptions, and to the extent permitted by law, our total liability to you in connection with an order is limited to the amount you paid for that order.

22. Indemnity

To the extent permitted by law, you agree to compensate us for loss or damage we suffer as a direct result of your fraud, your deliberate misuse of the website, or your breach of section 15 of these Terms.

23. Events outside our control

We are not responsible for any delay or failure to perform our obligations caused by events outside our reasonable control, including natural disasters, severe weather, epidemics, fire, flood, strikes, civil disturbance, government action, transport or courier disruption, and failures of power, internet or third-party systems. If such an event affects your order, we will tell you, and if we cannot fulfil the order you will receive a refund for anything you have paid for but not received.

24. Privacy

Our use of your personal data is described in our Privacy Policy, which forms part of these Terms.

25. General

  • Severability: if any provision of these Terms is found to be invalid or unenforceable, the remaining provisions continue in effect.
  • Waiver: if we do not enforce a right immediately, that does not mean we have waived it.
  • Entire terms: these Terms, together with the policies referred to in section 2, set out the terms on which we sell to you.

26. Changes to these Terms

We may update these Terms from time to time. The version published on this page, with its effective date, applies to your use of the website from that date. The Terms in force when you place an order apply to that order.

27. Governing law and jurisdiction

These Terms are governed by the laws of India. Subject to the next sentence, the courts of competent jurisdiction in Maharashtra will have jurisdiction over any dispute arising from them. Nothing in these Terms limits your right as a consumer to approach any consumer commission or forum having jurisdiction under the Consumer Protection Act, 2019, or any other remedy available to you under applicable law.

28. Your statutory rights

Nothing in this document excludes, limits or waives any right you have as a consumer that cannot lawfully be excluded, limited or waived. If any part of this document conflicts with applicable Indian law, applicable law prevails.

30. Grievances
